What Happened

The new regulation, signed in November 2026, overhauls the 2021 Omnibus Law provisions for foreign property Ownership in Bali. Key changes include:

Leasehold rights extended from 25 years to a maximum of 50 years, with two possible 25-year renewal options, totaling up to 100 years.
PT PMA minimum investment threshold reduced from IDR 10 billion (approx. AUD 1 million) to IDR 5 billion (approx. AUD 500,000) for property-focused companies.
Clarified that PT PMA entities can now hold freehold title (Hak Milik) for commercial use, but leasehold (Hak Sewa) remains the standard for residential villa projects aimed at foreign buyers.
Streamlined approval process for Australian investors, with a dedicated fast-track desk at the Bali Investment Board.
New requirement: 30% of total villa units in any foreign-backed development must be offered to Indonesian citizens at market rates before international sales can commence.

The Impact on Aussie Investors

Extended leasehold terms make Bali villa investments more viable for retirement or generational wealth planning, with 100-year maximums reducing renewal risk.
Lower PT PMA thresholds open the door for smaller Australian syndicates or individual investors to form a legal entity, previously only feasible for high-net-worth groups.
Clarity on PT PMA freehold for commercial use allows Aussie investors to diversify into mixed-use developments (e.g., retail plus residential) without legal ambiguity.
The 30% local quota may slow project timelines but ensures community buy-in, reducing political risk for long-term holders.
Aussie dollar strength against the rupiah (projected at 1 AUD = 11,500 IDR in late 2026) makes entry costs more attractive for Australian buyers.

What You Must Do

Review your current Bali property structure: If you hold leasehold under old 25-year terms, consult a Balinese notary (PPAT) about converting to the new 50-year framework.
Form a PT PMA now: With lower thresholds, consider pooling with other Aussie investors to meet the IDR 5 billion minimum for a dedicated property company.
Secure a local partner: The 30% local quota requires early engagement with Indonesian developers or agents to ensure compliance.
Monitor currency markets: Lock in exchange rates with a forward contract if you plan to transfer funds in early 2027, as rupiah volatility is expected post-regulation.
Engage a licensed Bali property lawyer: Only use practitioners registered with the Indonesian Advocates Association (PERADI) to avoid scams in the new regulatory market.
