The New land Law: What Changed

Indonesia's government quietly passed a new regulation in July 2026 that restructures foreign leasehold rights across the archipelago. The headline number every Australian investor needs to know: the standard leasehold term has been reduced from its previous maximum to a capped period, with renewal conditions that many existing owners didn't anticipate. Pertama Property's legal partners confirmed the regulation applies to all new leasehold agreements signed after 1 August 2026.

The change targets the widely-used initial 30-year lease with two 30-year renewal options. Under the new framework, the initial term remains at 25 years, but the renewal paths have shifted. Foreign investors now face stricter end-of-term conditions that could reduce the effective holding period.

Timeline: How We Got Here

June 2025:

Initial draft regulation circulated among Indonesia's investment board BKPM. Industry groups warned of investor impact.

March 2026:

Final draft approved by cabinet. No public consultation period was offered.

July 2026:

Regulation signed into effect. New leaseholds after 1 August fall under the new rules.

August 2026:

Existing leasehold owners begin reassessing property valuations — early estimates show 15-40% value reduction on recent purchases.

The Impact on Your Investment

Three immediate effects for Australian investors holding or considering

Bali

leasehold property:

1. Reduced effective ownership period.

A standard leasehold that previously offered up to 90 years of total term (30+30+30) now offers a maximum of 70 years (25+25+20) under the new structure. For an investor buying today, that is 20 fewer years of rental income, directly reducing the property's net present value.

2. Valuation shock on resale.

Leasehold properties are priced based on remaining term. A villa with 25 years remaining under the old rules commanded a premium because buyers anticipated 65 more years at renewal. Under the new rules, that same property has only 45 years of guaranteed term. Pertama Property's transaction records show a $30,000-$45,000 value drop on leasehold villas in Canggu and Seminyak since the announcement.

3. Financing constraints.

nks offering Bali property loans against leasehold assets are reassessing their lending criteria. Reduced lease terms mean reduced collateral value. Borrowers who purchased at 70-80% LVR may find their loan-to-value ratio has exceeded bank thresholds, triggering margin calls or refinancing demands.
