Freehold (SHM): The Full Ownership Option

Freehold in Indonesia (Sertifikat Hak Milik or SHM) is technically restricted to Indonesian citizens. Foreigners cannot hold SHM title directly. The workaround used by most Australian

investors is a nominee arrangement — a Indonesian national holds the SHM on trust while a separate agreement grants the foreign investor beneficial ownership. This structure has worked for decades but carries inherent enforcement risk if the nominee reneges.

The cost difference between freehold and

is substantial. A freehold 90m²

in Canggu costs $350,000-$500,000, while the same villa on

costs $180,000-$280,000. That $120,000-$220,000 gap is the premium for indefinite ownership rights. Freehold also outperforms on capital growth — 8-14% annually compared to 5-10% for leasehold

investment is recorded directly in your name at the National Land Agency (BPN).

HGB properties generate higher net rental yields because the lower entry cost means the rental income represents a higher percentage return. A $200,000 leasehold

villa generating $22,000/year in gross rental income yields 11%, versus 7.3% for the same rental income on a $300,000 freehold villa. The trade-off is 30-50% lower capital appreciation, since the building's value declines as the HGB term runs down.

Understanding Leasehold vs Freehold is crucial when investing in Bali property in 2026.
Leasehold vs Freehold refers to the specific considerations investors must understand before purchasing real estate in Bali. International buyers face unique regulations, cultural nuances, and market dynamics that differ significantly from Western property markets.
Always work with a licensed notary (PPAT) who specializes in foreign property transactions. They can conduct a thorough due diligence check on the certificate of title (SHM/SHGB), verify there are no encumbrances, and ensure the seller has clear legal authority to transfer the property.
Popular areas include Canggu, Seminyak, Ubud, Sanur, and Uluwatu. Each offers different advantages: Canggu for rental yield, Ubud for holistic lifestyle, Sanur for family-friendly environment. Your choice should align with your investment strategy and target market.
Foreigners cannot own freehold land (SHM) directly. The most common structures are leasehold (Hak Sewa) for 25-30 years with renewal options, or using a PMA (Foreign Investment Company) to hold Hak Pakai (Right to Use) or Hak Guna Bangunan (Building Right) titles.
Annual costs include property tax (PBB, ~0.1-0.5% of assessed value), maintenance fees (5-15% of rental income if managed professionally), association fees for gated communities, and utilities. Budget approximately 15-20% of gross rental income for operational expenses.
