Nominee arrangements — where an Indonesian national holds SHM title on behalf of a foreigner — are not legally recognized. Risks include the nominee selling the property without consent, creditors seizing the asset, inheritance disputes, and the foreigner having no legal recourse if the relationship sours.

For villa investments, a Hak Pakai title with a 30-year initial term (renewable for 20+30 years) is safest for residential use. For commercial properties like rental villas, a PT PMA company holding HGB (Right to Build) title provides the strongest legal protection. Always use an experienced notary (PPAT).

Professional fees range from $3,000-$8,000 for a complete ownership structure setup including PT PMA incorporation, notary services, and legal review. This is a small fraction of the total investment and essential for risk mitigation. Avoid cut-rate legal services that may cut corners.

No, leasehold cannot convert to Freehold for foreign owners. Leasehold agreements have a fixed term (typically 25-30 years with renewal options). If you want ownership without time limits, Hak Pakai with indefinite renewal is the closest option. Always negotiate renewal terms at the outset.
